  • This User Agreement
  • This User Agreement (together with the documents referred to in it) sets out the terms of use on which you may make use of our website TRENDiPEOPLE.com (the “Site”), whether as a guest or a Member. Use of the Site includes accessing, browsing, or registering to use the Site.

    Please read this User Agreement carefully before you start to use the Site, as these terms will apply to your use of the Site. We recommend that you print a copy of this User Agreement for future reference.

    Your use of the Site means that you accept, and agree to abide by, the terms of this User Agreement, which is a part of and incorporates by reference all the Terms of ServiceA at TRENDiPEOPLE.com including all Site information referenced or linked therein (“Terms of Service”). Capitalised terms not defined in this User Agreement are defined elsewhere in the Terms of Service or have the meanings given to such terms on the Site.

    TRENDiPEOPLE Limited (“we” or “us”). We are registered in England and Wales under company number 13828756 and we have our registered office at Studio 211, The Mirror Works Building, 12 Marshgate Lane, London, E12 2NH, United Kingdom. “TRENDiPEOPLE.com and TRENDiPEOPLE” are UK registered trade marks of TRENDiPEOPLE Limited.

  • Changes to User Agreement/Site
  • We may revise this User Agreement at any time by amending this page.

    Please check this page from time to time to take notice of any changes we made, as they are binding on you.

    We may update the Site from time to time, and may change the content at any time. However, please note that any of the content on the Site may be out of date at any given time, and we are under no obligation to update it.

    We do not guarantee that the Site, or any content on it, will be free from errors or omissions.

  • Overview
  • The Site is a venue where our Members use our platform for online work. Clients and Freelancers become Members when they open Accounts pursuant to this User Agreement. As Members, they use the Site directory, Diary, Book a Freelancer, Search, Contacts functions to advertise, locate, introduce themselves to each other, screen and select each other, negotiate Booking terms, and enter into Member Contracts between each other. Once two Members enter a Member Contract, they use the Site to collaborate, manage and perform their Booking.

  • Relationship between Client and Freelancer
  • The Client and the Freelancer acknowledge and agree that when a Freelancer ‘Confirms’ a Booking requested by a Client, the Client and the Freelancer will be deemed to have entered into a Member Contract comprising the Booking terms awarded and accepted on the Site, and any other contractual provisions accepted by both Client and Freelancer and uploaded to the Site, to the extent not inconsistent with our Terms of Service.

  • Relationship with TRENDiPEOPLE
  • TRENDiPEOPLE is not a party to the dealings between the Client and the Freelancer, including enquiries, posts, proposals, screening selection, contracting, performance of Freelancer Services and payment for a Booking. TRENDiPEOPLE does not introduce Freelancers to Clients or help Freelancers receive Bookings. TRENDiPEOPLE solely makes the Site Services available to enable Freelancers to identify and determine the suitability of Clients for themselves and to enable Clients to identify and determine the suitability of Freelancers for themselves. TRENDiPEOPLE does not direct, has no control over, makes no representations, and does not guarantee the quality, safety or legality of Freelancer Services, the truth or accuracy of the Booking the qualifications, background, or identities of Members, the ability of Freelancers to deliver Freelancer Services, the ability of Clients to pay for Freelancer Services, or that a Client or Freelancer can or will actually complete a transaction.

    TRENDiPEOPLE is not required to and may not verify any information given to us by Freelancers or Clients, nor does TRENDiPEOPLE perform background checks on Freelancers or Clients. TRENDiPEOPLE may provide information about a Freelancer or a Client, such as geographical location, or verification of identity or credentials. However, such information is based solely on data that a Freelancer or a Client submits. TRENDiPEOPLE provides such information solely for the convenience of Members and is not an introduction, endorsement or recommendation by TRENDiPEOPLE.

    The Client and the Freelancer acknowledge and agree that the value, reputation, and goodwill of the Site depend on their performance of their covenants and agreements in their Member Contract and therefore agree to use all reasonable endeavours to perform their obligations in accordance with any Member Contract formed.

    This Agreement and any registration for or use of the Site will not be construed as creating or implying any relationship of agency, franchise, partnership or joint venture between you and TRENDiPEOPLE, except and solely to the extent expressly stated in the Terms of Service.

  • Accessing the Site
  • The Site is made available free of charge.

    We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. Access to the Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We will not be liable to you if for any reason the Site is unavailable at any time or for any period.

    You are responsible for making all arrangements necessary for you to have access to the Site.

    You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

  • Your Account and Password
  • If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

    We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

    If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at help@trendipeople.com

  • Bookings
  • When making/receiving Bookings, you agree to abide by the following guidelines:

    • Make Booking enquiries with clear scope, well-defined deliverables and required time frames. Do not hesitate to contact Customer Support for assistance with making a Booking.
    • Answer clarifying questions from Freelancers and update the Booking.
    • Accept a quote from a Freelancer only when it has a clear description of the work, well-defined deliverables and milestones, precise timeframes and payment terms.
    • Consider your options against criteria important to you, such as a Freelancer’s work experience, education, portfolio, certifications, references, feedback from prior Clients, location, communication style and cost.
    • Ask the Freelancer to set out key milestones and payment schedules.
    • Ask for the Freelancer’s office hours and standard response times.
    • Once you have ‘Confirmed’ a Booking, log onto the Site to manage the Booking and communicate where necessary with your Freelancer.

    You agree NOT to do the following when you make a Booking or transmit information on the Site:

    • Submit any Booking or proposal, or otherwise use TRENDiPEOPLE to transmit any content or conduct any transaction that would violate any applicable law or regulation in the UK or any country.
    • Submit any enquiry for a Booking that is fake, posted without the intention to hire or complete Booking.
    • Submit any enquiry for a Booking that offers commission or equity compensation.
    • Require or request that a Freelancer deliver a free mock-up or proof of concept as part of a proposal submission or as a condition to consideration of a proposal, unless these terms are agreed in writing before work commences.
    • Submit any enquiry for a Booking or proposal, deliverable or transmit any content that infringes a third party’s Intellectual Property Rights, license rights, the terms and conditions of use of such third party’s web site or copyrighted materials or such third party’s rights of publicity or privacy.
    • Submit any enquiry for a Booking related to bulk email or spam, including but not limited to bulk email hosting, scripts, active code, programs, proxies, lists and relay servers.
    • Submit any enquiry for a Booking or proposal that violates, or has the potential to violate, the integrity of academic and professional applications, tests and work, for example, by passing off the skills, ideas or words of another as one’s own; using another’s production or content without crediting the source; presenting as new and original, ideas or products derived from an existing source; presenting fabricated facts, persons or sources as real.
  • Intellectual Property Rights
  • We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it with the exception of User Content. Our works are protected by copyright laws and treaties around the world. All such rights are reserved.

    You retain all your ownership rights in any User Content you post on the Site. You also grant to TRENDiPEOPLE LIMITED, and/or its successors, a royalty-free, sub-licensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Site and TRENDiPEOPLE’s (and its successors’) business, including without limitation for promoting and redistributing part or all of the Site (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each User a non-exclusive license to access your User Content through the Site, and to use, reproduce, distribute, display and perform such User Content, only to the extent permitted through the normal functionality of the Site and subject to all applicable confidentiality and other provisions of the Terms of Service.

    Notwithstanding the foregoing paragraph, TRENDiPEOPLE will only use or disclose User Content you post to any area of the Site to the extent necessary to provide Site Services to you.

    You may print off one copy, and may download extracts, of any page(s) from the Site for your personal use and you may draw the attention of others within your organisation to content posted on the Site.

    You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

    Our status (and that of any identified contributors) as the authors of content on the Site must always be acknowledged.

    You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us or our licensors.

    If you print off, copy or download any part of the Site in breach of these terms of use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

  • No Reliance on Information
  • The content on the Site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Site.

    Although we make reasonable efforts to update the information on the Site, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or up-to-date.

  • Limitation of Our Liability
  • Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

    To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied.

    We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

    • use of, or inability to use, the Site; or
    • use of or reliance on any content displayed on the Site.

    Please note that in particular, we will not be liable for:

    • loss of profits, sales, business, or revenue;
    • business interruption;
    • loss of anticipated savings;
    • loss of business opportunity, goodwill or reputation; or
    • any indirect or consequential loss or damage.

    We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any content on it, or on any website linked to it.

    We assume no responsibility for the content of websites linked on the Site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

  • Uploading Content to the Site
  • Whenever you make use of a feature that allows you to upload User Content to the Site, or to make contact with other users of the Site, you must comply with the content standards set out in our Acceptable Use Policy

    You warrant that any such contribution and any User Content complies with those standards, and you will be liable to us and indemnify us for any breach of that warranty.

    Any User Content will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose, in accordance with our Privacy Policy

    We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to the Site constitutes a violation of their intellectual property rights, or of their right to privacy.

    We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of the Site.

    We have the right to remove any posting you make on the Site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy

    The views expressed by other users on the Site do not represent our views or values.

  • Viruses
  • We do not guarantee that the Site will be secure or free from bugs or viruses.

    You are responsible for configuring your information technology, computer programmes and platform in order to access the Site. You should use your own virus protection software.

    You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

  • Linking to the Site
  • You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

  • Third Party Links and Resources in the Site
  • Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only.

    We have no control over the contents of those sites or resources.

  • Termination
  • This User Agreement will become effective upon your first visit to the Site and will remain in effect for the duration of your use of the Site. Unless both you and TRENDiPEOPLE agree otherwise in writing, either of us may terminate the contract represented by this User Agreement in our sole discretion, at any time, without explanation, upon written notice.

    In the event you properly terminate this Agreement, your Account is automatically terminated; however, (i) if you have any open Bookings when you terminate this User Agreement you will continue to be bound by this Agreement until all such Bookings have closed; and (ii) you will continue to be obligated to pay any amounts accrued but unpaid as of the date of termination to any Freelancers for any Freelancer Services. Without limiting any other provisions of this User Agreement, the termination of this User Agreement for any reason will not release you or any Member with whom you have entered into a Member Contract from any obligations incurred prior to termination of this User Agreement or that thereafter may accrue in respect of any act or omission prior to such termination. Those Site Policies necessary to implement the foregoing survive termination of this User Agreement for any reason.

  • Applicable Law
  • This User Agreement, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

  • Definitions
  • Account: the TRENDiPEOPLE Account you open when you register to become a Member and use the Site Services.
    Booking: a booking you made, received or added via the Site.
    Client: a Member that investigates and purchases Freelancer Services or identifies a Freelancer through the Site.
    TRENDiPEOPLE
    /we/us:
    TRENDiPEOPLE Limited, a private limited company registered in England and Wales under company number 13828756
    Freelancer: a Member that offers and delivers services or identifies a Client through the Site.
    Freelancer Services: all services performed for or delivered to Clients by Freelancers.
    Member: a person or legal entity that registers for an Account.
    Member Contract: the Booking terms, as awarded and ‘Confirmed’ on the Site, and any other contractual provisions awarded or ‘Confirmed’ by both Client and Freelancer and uploaded to the Site, to the extent not inconsistent with the Terms of Service.
    Site: the domain and all and any sub-domains of trendipeople.com and any mobile or web services or applications owned, controlled, or offered by TRENDiPEOPLE such as the TRENDiPEOPE PRO and TRENDiPEOPLE Apps.
    Site Policies: means the Terms of Service and all obligations, requirements, and guidelines contained in or linked from the Site. Site Policies includes, without limitation, all documents linked here Terms of Service
    Site Services: all services that are accessible through the Site, except Freelancer Services.
    Terms of Service: this Agreement and all the other Site information agreements and policies referenced or linked therein or from the following URL: Terms of Service.
    User: a person who is a Member, using the Site on his or her own behalf, for his or her business purposes, and not for personal, household, or consumer use, or (2) a person who is authorised to use the Site on behalf of a Member that is a company or organisation for business purposes, and not for personal, household, or consumer use.
    User Content: any data, information, content, text, video, music or other information that you post to any part of the Site.

    This policy (together with Our Terms and Conditions of Use and any other documents referred to in either document) explains how We collect, use and handle any personal information We collect from you when you use Our website at www.trendipeople.com (our ‘Site’) and Our mobile app (our ‘App’), both of which together We call Our ‘Services’.

    Please read the following carefully to understand Our views and practices regarding your personal data and how We will treat it. By visiting the Site or the App or using Our Services you are accepting and consenting to the practices described in this policy.

  • COLLECTING YOUR PERSONAL INFORMATION
  • Our platform exists to help our members and users to manage their freelance work and to find career opportunities and talent. With this goal in mind, we may collect and process the following data about you:

    You may give Us information about you or relating to you:

    • if you register to become a user of Our Services;
    • if you manage booking in your Calendar;
    • if you raise invoices or timesheets;
    • if you use the time tracking tool;
    • if you use any of our ‘Services’, including the App;
    • if you send Us a message through Our Services or correspond with Us by telephone in writing or otherwise.

    To register, We ask that you provide Us with certain personal information, which will generally include your name, address, phone number, email address, academic record and profile picture (each to allow Us to customise your experience), a username and a password created by you. You may also elect to upload materials to your profile that include personal information. Please do not post or add personal data to your profile that you do not want to be publicly available.

    Information We collect about you. With regard to each of your visits to Our Services, We may automatically collect the following information:

    • technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, your ISP and/or mobile carrier, browser plug-in types and versions, operating system and platform, your location (if you are accessing the Services from a mobile device (note that most mobile devices will allow you to prevent location data from being sent to us));
    • information about your visits, including the full Uniform Resource Locators (URLs) to, through and from which you access Our Service (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to contact us.

    Information We receive from other sources.

    • Others may post, book, write about and tag ('credit') you, or link to your profile through the Services (known as ‘following’).
    • You and others may post content that includes information about you on Our Services.
    • For identification purposes, if you create an account with Us using Google’s Gmail's log-in credentials, We may import your public profile image from these sites to use in profile on Trendipeople, but only if you have authorised these sites to provide this to Us.
    • Customers and partners may provide data to us.
    • We work closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers and search information providers) and may receive information about you from them.

    At present these services are provided by the following entities and / or their groups of companies:

    • Facebook, Inc. and Facebook Ireland Limited
    • Google LLC, Google Ireland Ltd
    • Google GSuite
    • Google Calendar

  • HOW WE USE YOUR PERSONAL INFORMATION
  • The purpose for which We use and process your personal data (excluding sensitive personal data) and the lawful basis on which We carry out each type of processing is explained below.

    • GENERAL USE OF SITE
      • To create, personalise, provide support and maintain your user account and profile for Our Services.
      • To send you information about your account, the facilities We or Our related companies provide or changes or upgrades that We make to those facilities.
      • To authenticate you and authorise access to Our Services. Legitimate interests.
      • To alert you via email of relevant opportunities and activities (including, without limitation, bookings, content and notifications.
      • To operate a customer helpdesk service to respond to membership queries.
      • To log certain security and privacy-related activities that occur on your account in line with our legal obligations.
    • NETWORKING & CAREER DEVELOPMENT
      • To allow you to seek out and be found for booking opportunities.
      • To allow you to invite freelancers to bookings.
      • To promote our members profiles and careers, such as promoting your work or profile.
      • To send you newsletters which you may elect to receive.

      Except as set out in this Privacy Policy or otherwise agreed by you, We will not share your personal information with third parties (such as marketing companies) or use your personal information other than for Our internal purposes.

      We do not store credit card details.

      We monitor for and try to prevent security breaches.

  • ADVERTISING AND COOKIES
  • We use 'cookies' and similar technologies (e.g. web beacons, pixels, ad tags, and device identifiers) to identify information about your web browser session and personalisation data each time you visit and use Our Services. A 'cookie' is a small data file that will be stored by your web browser when you access Our Services. These cookies do not contain any of your personal information such as name or email, the information stored in the cookie will only identify you to TRENDiPEOPLE. Cookies can be used to enhance your use of Our Services, as We use them to help personalise Our delivery of services and material to you, such as information which is most relevant to your profile and interests.

    You can set up your browser so that it does not accept Our cookies. You can also manually delete Our cookies from your browser. However, you will not be able to login to Our Services without cookies being enabled on your browser. When browsing without logging in, some features may not behave as intended when cookies are not accepted.

    Cookies from other entities – ‘third party’ cookies – may also be set on your devices.

  • HOW WE MAY SHARE YOUR INFORMATION
  • We may engage third parties to undertake some of Our Services or related services such as hosting, archiving, data security and email communications. We may provide those third parties access to personal information for the sole purpose of them providing their services to us. We will use reasonable endeavours to ensure that those third parties only use your personal information for the specific purposes for which it is provided to them and consistently with this Privacy Policy.

    We use others to help provide Our Services (e.g. maintenance, analysis, audit, payments, fraud detection, marketing and development). They will have access to your information as reasonably necessary to perform these tasks on Our behalf and are obligated not to disclose or use it for other purposes.

    We may also disclose your personal information:

    • to analytics and search engine providers that assist Us in the improvement and optimisation of Our Services;
    • to Our related companies;
    • to Our professional advisors;
    • to law enforcement authorities, if We suspect that an unlawful act is being committed or that such disclosure will prevent that unlawful act; or
    • as otherwise required or authorised by law.

    Other than the types of disclosures set out in this Privacy Policy or as otherwise agreed by you, We will not disclose your personal information to any third party.

  • PROCESSING OF PERSONAL DATA OUTSIDE THE EEA
  • The data that We collect from you may also involve transfer of your personal data to any country, including countries outside the European Economic Area, but that in those cases, except where the relevant country has been determined to ensure an adequate level of data protection by the European Commission or We need to make the transfer in order to perform a contract concluded in your interests, We will ensure that the transferred personal data is protected by a data transfer agreement in the appropriate standard form approved for this purpose by the European Commission or by a binding legal agreement. it may also be processed by our staff operating outside the EEA who work for us. Such staff maybe engaged in, among other the provision of support services or for other services required to enable us to deliver our service to you.By submitting your personal data, you agree to this transfer, storing or processing.

  • SECURITY OF YOUR PERSONAL INFORMATION
  • We implement security safeguards designed to protect your data, such as HTTPS. We regularly monitor Our systems and Services for possible vulnerabilities and attacks. However, We cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of Our physical, technical, or managerial safeguards.

  • THIRD PARTY WEBSITES
  • Please be aware that Our Services may contain links to third party websites. If you visit such websites, before providing your personal information on or in connection with those websites, We suggest you review the privacy policy and terms and conditions of use of the third party website.

  • YOUR ACCESS TO YOUR PERSONAL INFORMATION
  • You are entitled to know what personal information We hold about you. You are also entitled to update or correct your personal information. If you would like to contact Us in relation to your personal information, please do so by email to support@trendipeople.com. As of 25 May 2018, these rights will be replaced by their equivalents in the “GDPR” section immediately below.

  • YOUR RIGHTS UNDER THE GENERAL DATA PROTECTION REGULATION (“GDPR”)
  • You shall have the right, in accordance with the GDPR, to obtain from Us the following: Right of confirmation: Confirmation as to whether or not personal data concerning you are being processed.
